Check with the town ordinance laws in your town and state because so many factors go into play with that like the age of the tree the weather how much rain you may have had that made the tree vulnerable to high winds and the stability of the ground were the tree was from saturation of some much water bug infestation you name it get my point now and how well the tree was maintained during growth I mean like trimming and what ever else needed to be done to keep the tree safe.
But if you ask me personally if my neighbors tree falls on my property and did damage than my neighbor is liable simple as that it may sound simple but like I said it varies from state to state.

It used to be straightforward- the property owner where the tree was rooted was liable...but since the insurance companies are the ones that pay [or not], let them deal with it.
