The common law is the law that has developed as a result of "common" usage. That is, the way things are done. That common usage is determined by court cases.

The torts act to which you refer is a legislative enactment. It changes the common law of torts in those circumstances to which it applies.

In a contest between the common law and a specific leglslative act, the act always wins.

Common law refers to the body of judicial decisions that courts have handed down within a particular jurisdiction.

Any "Act" refers to a legislative law, which overrules any court interpretations of prior statutes (not constitutional issues).

To answer the rest of your question, you'd need to specify what law you were talking about, what jurisdiction it was in, and then someone would need to research all the prior court rulings on that subject. Not what most people do for free.
