The horses should not be tethered just because the field is next to a road. It is the reponsibility of the horse and land owners to ensure that animals in the field cannot get out. This means asequate fencing to prevent this. Obviously the owners of the horses are very irresponsible if they can just get out whenever they feel like it. It is dangerous for the animals and for vehicles using the road. We graxe our cows in fields next to a busy A road, but it is our responsibiltiy to ensure they don't get out onto it and remain in the field. If they did get out and caused an accident then we would be prosecuted and our insurance would be expected to cover all costs and damage.

well in Texas if a horse or a cow gets into the road whether they were tethered and got loose or in a fence and got out the owner of the animal is responsible for any accidents that are caused by that animal.there are many cases where the owner can not be found.
it may depend on the state

Well you asked and answered your won question because that is common sense not unless you want to be sued if the horses cause and accident and someone gets hurt,injured or killed so what do you think you should do.
Now if the horses are wild horses not own by anybody that is different but horses own by a person can get into a lot of trouble if they cause and accident you can bet on that.

Animals on common land aren't under any control, there should be signs on the roads telling drivers about free roaming animals and it doesn't matter if it's a sheep, a horse or a deer, it's o.k. for them to be there and it's up to the car driver to look out for them. If you are on country roads you shouldn't be driving fast in any case. Chill out, slow down, life is too short.

It depends on weather the horses/ponies are owned by law abiding tax paying citizens,group A.
or pikey's diddicoy's or hedgemumpers, gorge-rs may also fall into group B.
group A would certainly be moved off by the local constabulary
group B can and do get left alone

Common sense tells you (if you know about horses), that something can come out of the ordinary and 'spook' them at times. It's better to tether them.

if the horses did it of their own accord than probally not. But hell if i know, in Jersey, we dont have horses.
