Today i went out to get my mail, and i live in an apartment complex. And i had a letter from the sheriff's department stating that there was a self offender living in complex. This man was convicted of RAPE!!I feel unsafe in this place, and if my boyfriend is away i shouldn't have to worry about my safety. My question is..does the apartment complex have to move this man in, and do i have a right to get out of my lease for feeling unsafe??Would i have a valid argument??

What you should do is get on the state corrections site and see exactly what he was convicted of before being scared, many times people will gossip and not get the full story from the offender, i am not saying to confront him, but at least do some research to try and put your mind at ease, for all you know he could have raped another man or something and in that case your boyfriend is the one that should worry, people are sick, he could be charged with raping a dog! stranger things have happened. Also check and see if this person is a repeat offender or this was a one time deal. Keep your door locked and an eye on this guy and if he proposes a threat in any way let him know you mean business by calling the police. Chances are if this guy has any sort of brain that works properly he is not going to violate any more laws because he does not want to go back to prison... weigh it up, if you were on parole for something would you wanna screw up and end up back in prison? I know his charges are harsh but at least give a fair chance while holding on to a full can of unlocked pepper spray in your pocket just in case. And if you want out of your lease out of fear, sit down and have a talk with the apartment landlord or manager and sincerely explain the problem you are having with this, anyone would be understanding in this matter i would assume, even a landlord. Not from a legal perspective, no.

The apartment complex cannot discriminate against someone just because they committed a crime in the past. At least, not under the laws of most states.

And you are not entitled to break your lease just because you think someone might commit a crime in the future, or just because they committed a crime in the past. The apartment complex was not rendered objectively non-habitable, and thus you have no legal grounds to be excused from your lease.

You can ask the apartment complex to release you, but that would be up to them. Other than that, until this person has threatened you, or violated a restraining order that you obtained, you have no legal recourse just because you're scared.

He has the right to move in. You cant take that away. But you do have the right to break your lease.
