As far sentence of punishment is concerned the court decide this on the basis of the facts of the case, evidence on record, circumstances of the whole case, the age of the parties involved in the offence both the victim & the offender, the social standing of the offender, the social standing of the victim, past criminal records of the offender, the gravity of situation under which the offence was committed, social influence of the offence, past cases where such offences were sentence for how much period & amount of fine, etc, based on these the court decide the term of sentence & it varies from case to case on these bases only, hence you see in some cases the court gives minimum punishment "till the raising of the court" & fine where as in some cases the maximum prescribed punishment is awarded. Similarly in some cases the sentence of jail is given as with simple imprisonment & in some sentence of jail with rigorous imprisonment,& still in some the jail sentence is simple imprisonment for some period & rigorous imprisonment for rest of the period of time. All these terms of imprisonment too are based on the facts I mentioned above. Just by the way the case of Rape by 90years man of a female (17years) you mentioned here is amazing & unbelievable, I will be interested know the whole facts of this case if you can send then to me on my email directly I shall be highly obliged.

I'm not sure I even understand the question, but I too have to wonder how a 90 year old would have the strength and agility to rape a 17 year old unless he drugged her somehow. Do you have a source?

How can a frail 90 year old man rape a 17 year old?
She probably did it willingly - maybe even for cash and now is trying to frame the poor old guy.
