We just bought our townhouse 4 months ago and he hasn't shared any of the mortgage payment. I payed everything, from downpayment, bank fees and monthly mortgage payment. We also have a car that I have paid off myself. As you can see I am the bread winner in the family. my husband doen't have a permanent job. we have been married for 4 years. but out of those years, i'd say 3 years straight, i was the in charge of all the bills even grocery. sometimes he gets a part-time job but he keeps his wage to himself. my question is,will the family law court split our property in halves eventhough he has not shared that much? isn't that unfair? please advise. thank you very much

If you are in the USA, most states do the 50/50 split regardless of who is paying what. This is what marriage is all about.

If the tables were turned where he was the total bread winner and you were a stay-at home spouse, you wouldn't be feeling this way as you would feel you were entitled to 50% and probably spousal support.

I am not sure why you purchased a townhouse only 4 months ago when you clearly saw the signs that he hadn't had a full-time job for nearly 3 years. This was clearly a "red flag".

Be careful as he might go for spousal support since you did it all for nearly 4 years.

There is a lesson to be learned here for the next time. I have been there myself so I do understand and I learned my lesson.

Hi, I went through a divorce and I got everything, the house, the clothes, the ride and a broken heart. Really . You need a very good lawyer. Let your lawyer know everything that you have done in the marriage financially. You might even have to write a letter to the judge..(I did) I don't see a problem with you getting everything. We lived in Washington state which is a community property state. I was so sure that we would have to sell the house and the car. etc. My lawyer just presented my case to the judge. I was sooo happy that I got everything!

Honey, why do you want to do something which you will regret later in life. You are offering this man a proposal which means - You can have the cake & eat it too . Thats against the natural law. If you dont want legal or police hassles , then do the wise thing. Just take sabbatical One year break from this relationship on the pretext of you need time to sort out the issue. Make sure you are not in touch with him in any manner - No txt, no Phone, No miss call, No chat . No seeing him ... nothing. This will have twin benefits: 1. it will give you time to evaluate your decision as well as this relationship - whether you still want to spend rest of your life in this relationship or was the decision rash.... 2. it shall help this man to sort out the mess in his personal life. Either he will divorce/file for divorce to his wife or go back & mend his relationship with them. This shall take the legal hassle away from you & your family. If after one year, both of you still feel the same way , then go ahead. Take on the whole world... Dont worry about anything . Just do it. Ask him to leave his wife & File for divorce...and both of you can get married to each other.

He will probably get a fair amount especially if he is on the deed to the house...won't matter if he is on the mortgage, the mortgage is just the way you pay for the house the deed is the actual ownership, you can't even seel the house without his signature if he is on the deed. I would get all records of past bills and who paid for what but in the end you will end up losing some.

Hire an attorney and tell him/her that you can easily afford the house and have been the only one making all the payments and you want the house. Show them the reciepts and don't forget to add that your soon to be ex has a problem keeping a job and has no steady money coming in and hell he can't even afford a loaf of bread let alone a house.

Switch with a man , for a second.... Stay at home wife..... Does she get half if they divorce? Most likely. Is it fair? If your the wife, or in your case, your husband? Yes. Some one has to provide for a sedindary partner, so it has to be the working one. Not every one thinks the accumilation of money is the highest of priorities.

I, think that depend s on the lenght of the marriage, what the courts decided, i know for myself i am going though the the same divorce and mostly i have not work, raising children and off and on work. my husband, has to give me support, i do get half, 28 years. i think ever situation diffrent. I, think it s up to the court and what state you are living in. for myself, my hubby travels out of the country and supports another family, for 4 years now.. every situation diffrent. you might probably get half of what he is making. I would suggest you check into it.

Get a goooood lawyer, in Oz, he will probably be entitled to 50/50 regardless of who was the breadwinner... he can go after half of your superannuation too (and vice versa), my friends are going through a separation at the moment and its getting nasty... get some legal advice now!

I've heard these problems other way round............and if the law is same for both the sexes then you might have to loose more bucks as you told that you are the bread winner for the family....

Talk to a lawyer. Fortunately for you....you've only lived in the new home only 4 months, therefore do not have much if any equity in it.
