Just how "under 16" is this under 16 year old? Someone that age should be more than competent enough to watch an "under 10" year old. But in a typical "minors left home alone" case, the parent would lose custody of the children and go to jail for neglect.

Nothing, because legally a 12 year-old (13 in some states) can watch younger siblings, and babysit for neighbors, etc. If someone is considering calling the cops on this guy they need to back off and leave him alone. My husband was a single father for 9 years before I met him and he struggled financially and he could not afford day care or even an occasional babysitter, and due to the fact that he was a guy he could not get food stamps, or welfare for any help.

You would have to check with a lawyer in California to get an exact answer for your question. There are Federal laws that govern some of the regulations, and then State and Local that will govern others.
The custody of the children will most likely be lost, and they may even be placed in foster care.
The father could be fined or jailed or both, depending on the law in his area and the demeanor of the court. It will depend on if the court can prove that he habitually left the minor children alone or if it was a one time occurrence.
This is going to be a difficult lesson for all involved.

It depends for how long? While he went to the store? to the movie? to work? Or to Bermuda?
The 16 year old can stay alone. Period. He can drive. Go to prom. No question. he can stay alone.
he can care for the 10 year old for a limited amount of time in the home that they share.
We do not have nationwide rules on "how long" they can be left alone. You can leave them alone atleast while you go to work. Not for a week while you are on vacation. The 16 year old can't care for the younger child for that long.
You wont go to jail, worst they can do is request you take parenting classes. This is not a crime. Too many variations.

The older child is likely old enough to watch the younger child. I do not believe you have a problem as long as it is not a dangerous situation present. The only way someone would know is if Child Protective Services was notified or if there was an emergency situation. I would have a neighbor or friend nearby if it were me

No there will be no arrest but the police will give a call to child services if they think is worth it; Child services will not take the children (unless they find dead rats, rotten food and needles in the floor) but they will keep an eye on them.
Now if by any bad luck one of the minors get sick or injured (fire, choking etc) then there might be some arrests.

These children sound old enough to stay home together. 15 year olds babysit for little kids.

i think 16 is an old enough age to be home alone. 10 too.
