There is no correlation between a broken arm and cancer, and that injury is actually fairly common with childbirth. No, you cannot sue. The injury was not caused by your doctor's carelessness - it was simply caused by nature and your daughter's trip down the birth canal. She will likely heal 100% and have no future problems.

7 lbs 1 oz is NOT a small baby - in fact, anything between 6 and 8 is considered average.

Being in labor for 15-16 hours is actually considered a short time period for many women, especially first-timers.

Your daughter will not get cancer because she was born with a fractured arm.

You probably could file a claim, but I think it is absurd and the chances are you would not win in court.

Because she is so young, it will probably heal rather quickly with proper care and treatment.

Seven + pounds is not "really small", it is actually average for a newborn baby.

The doctor can predict that things should go smoothly because there have been no prior complications, but there is ALWAYS the possibility that something will arise. Every Mother should know that, and the doctor will focus on the good in order to prevent the mother from worrying about every possibility before it comes up. They can not anticipate everything that MIGHT go wrong.

Labor can last anywhere from a few hours to a few days, that is not the doctor's fault. It is also not his fault if your wife was fully dilated but the baby was not moving properly through the birth canal. And, it often happens that women are taken in for a cesarean and the baby is born naturally before the process can be completed.

To reiterate, your child will not get cancer because of her broken arm at birth, and while you could try I believe it would be ridiculous to sue. Such frivolous lawsuits are why OB/GYNs have to pay outrageous premiums for insurance, and why so many of them are choosing to leave the field.

Focus on caring for your wife and newborn daughter, and making sure her arm is cared for properly and there should be no long term effects.

Congratulations!

I am an OB nurse and a mom and a grandma.
YOU CAN'T SUE FOR THIS BELIEVE ME
And cancer NO WAY-- I can't believe you even asked this.

Besides you don't even know it it was the shoulder or arm.
That is horrible that YOU don't know. You are asking a serious question that you seem to know little about.

What happen is NOT so unusual at all.
15-20 hours of labor isn't that long

If a babies face is not facing the right way or is coming shoulders first or butt first or legs first.........it is a complicated birth. And a C section is in order.

A 7lb baby is very normal sized not small as you say.
Most likely there is a joint that snaped out of joint or a small fracture that rarely causes any long term consequences.

The baby most likely was not positioned right. Or your wife's pelvic opening was smaller than average. (and this can be whether or not the mother is petite or large) This is NOT the doctors fault. It is just nature.

Most likely what happened is that one of her shoulders was snapped out of the joint. It is often the shoulder or the hip that gets out of the socket. It is highly rare to actually break a bone. A newborns bones arn't that brittle. They are very flexible because God aka Nature knew that being delivered isn't a trip in the park.

150 years ago 1 out of 4 women died giving birth.

A baby that can't get out can be life threatening to both child and mother. There are times that the doctor actually let whatever happens happen because this can be life or death like I said to both mother and child. This is why we have our babies in hospitals. Instead of being upset, you should be greatful that you live in a time and age where there are doctors and nurses who know how to deliver a baby & how to treat complications.

This dosen't mean your wife can't have any more children.
Just make sure the doctor knows what happened before and the doctor will know what needs to or not to be done.

There is NO one to blame here. It happens.
Defiantly get more information from the doctor, you don't seem to have much of a grip on what actually happened.
From my experience the labor and delivery was all acceptable protocol.

Labor is an extremely difficult process on both the mother and the child. This probably happens more than you realize. I have two neices (different mothers) who were both born with fractured collar bones. They're in their 20s now and have never had any problems.

I'm sure there's a lawyer out there who would help you litigate something on this, but I don't believe in suing everybody for everything like in today's world. Sometimes things just happen. I seriously doubt any of the medical personnel assisting desired anything less for your wife/baby than the best birth possible.

Here's some additional info I found online; I've included the source below. Congratulations on your new baby!

FRACTURED COLLAR BONE

Causes And Risk:
This condition is fairly common during difficult births. A clavicle fracture can occur during difficult delivery of the shoulders in a vertex (head first) delivery or during breech (feet first) delivery, when the baby´s arms are extended above the head.

Symptoms:
There is generally decreased movement of the arm on the side with the fractured clavicle. Lifting the baby under the arms causes pain. Sometimes the fracture can be felt with your fingers, but more often there is no visible or palpable evidence of abnormality.

Within a few weeks a hard lump may develop where the bone is healing and may be the only indication that the newborn had a fractured clavicle.

Signs And Tests:
The fracture may be identified on a chest X-ray taken of the baby. Sometimes the baby´s refusal to move the affected arm may be misinterpreted as nerve injury.

Treatment:
Generally, there is no treatment other than lifting the child gently to prevent discomfort. Occasionally the arm on the affected side may be immobilized.

Prognosis:
Full recovery occurs without treatment.

Complications:
There are usually no complications. Due to the excellent healing potential of infants, later in life it may be impossible (even by X-ray) to tell that a fracture occurred.

I've heard of that happening many times. the birthing process is a hard thing for those poor babies to go through sometimes if they come out with an arm first or crooked that can happen.
you could talkto a lawyer but chances are slim you would get anything but the bill.
Sometimes even if you are fully dialated the baby is just to big or the mother is just to small for the baby to come out.
your doc can predict a good birth but it doesnt mean you will. experience tells me that i do'nt listen to when my doctor says i will go into labor and not to listen about how great it will go.
and i never heard of anyone a baby or not getting cancer from a broken arm!! thats silly.
congrats on the baby and just be happy that she came out normal and healthy a lot of mothers get worse things then a broken arm

My child's shoulder blade was broken during delivery. It does happen quite a bit. Some docs. do it when the baby seems stuck and they need to get the baby out. Sometimes the baby has nerve damage that may or may not be permanent. I guess it's the chance you take, either break the shoulder blade, or the baby and or mother is injured or dies as the result of when things go wrong in a delivery.

it happens a lot the mother is smaller than the baby that wants to get out. at 15-16 hours that is a great time for birth, i was in labor 3 days, so you lucked out. no just because her arm was fractured it can not cause cancer. just love her. from what you said the doctor did not do anything wrong. mother nature has a way of making humans look like fools most of the time.

she wont get cancer from it. also you would have a hard time trying to sue seeing as they were going to do a c-section and SHE decided to push the baby out. the fact is it isn't any bodies fault. the baby will probably be fine but they will need to do some tests to make sure she has proper use of the arm. only the Dr knows haw bad it is so they can answer better but you may want to take her to a different Dr just to be sure and she isn't small she is average sized

The baby's arm broke because she was crooked in the birth canal, Relax, she will be fine in a few weeks. This happens rarely, but it does happen. it can NOT lead to cancer. as for the doctor telling your wife she was going to have a really good birth, that is impossible to predict and is said by every doctor to every mother at least once during the pregnancy to calm the woman's nerves. congratulations of having a beautiful daughter. go to sleep, its probably the last time you will for about 6 months

no, no concern for cancer due to a broken arm
i am sorry to hear how traumatic your daughter's birth was!
my oldest son broke his collar bone at 16 months old and it took about 2 months to heal.

as to future pregnancies (i know early to think about) please realize that ALL pregnancies are DIFFERENT!! i've had 10 pregnancies and NONE have been the same. the docs are not always right, they do NOT know everything
