Our neighbor has recorded a conversation between us and another neighbor to possibly be used against us in court. The tape recorder was hidden and the neighbor we were speaking with knew about it.

as long a one of the parties involved knows they are being recorded it is leagl.now if a third part recorded the conversation with the other two not knowing,that is illegal

In most states, including Virginia, you have the right to be told before a phone conversation, interview, or interrogation is taped. In addition, company lawyers have the ethical responsibility of obtaining the consent of all parties prior to recording a conversation. If the recording is made without your knowledge or consent, it would be inadmissable as evidence in a court of law.

In some states, as long as one person in a conversation knows it is being recorded, it is legal to record it. I don't know if this is the case with VA or not.

As far as i know, the tape recordings can be admitted into evidence even if the other party was not aware of the recording. However, they will probably have to be authenticated before they can be admitted.

why not? at least one party knew about it and authorized it ... all the recording does is establish the veracity [truth] of what he will testify to.

Isn't this what you see all the time in the cop shows on TV when the good guy/victim wears a wire so the cops can arrest the nasty perp??
