My husband has been paying $41.33 per month for childcare. In addition for his child support. The problem is that the child hasn't been in childcare for some years. In fact, she turned 18 a week ago. Can we get this money back?

First question is who was he paying the child care to? The mother or the child care or the state..... In any case you can file a request to relinquish child care order. If he has paid to the state all of this back support from the time the child stopped recieving care can be discussed at that time. If it was to the mother or child care a civil suit may be in order. I would call your Child Support Recovery Unit, they have lawyers that can answer this question better.

Why didn't he file to stop child care payments years ago when she wasn't in care??

Depends on what state you are in. And it also depends on if your child support payments aren't behind. I do know you have to go to court to stop any child support payments other wise it takes the courts forever to stop the payments especially if they are automatically deducted from his paycheck. Look at his divorce papers and see how long he is to pay child support then go from there my best advise would be to make a court date to stop the payments and actually see if you will be able to get it back just by stop paying child support untill the money you paid in is even. if that makes any since.
