Presidents have claimed the power to withhold information from the courts and Congress, but no clause of the Constitution speaks of such a power, and questions regarding this are contentious and undetermined. The Supreme Court has ruled that presidential communications are protected by a privilege that is "fundamental to the operation of government and inextricably rooted in the separation of powers under the Constitution." Executive privilege, however, is not absolute.
