A close friend called me 6 months ago & asked me to let her borrow $500.00 for a down payment on a car.I went to the dealership & let them run my debit card. She then returned the car, got the money back, and put it down on another car at another dealership.She told me in the dealership the day that I let her borrow the money that she would pay me back in 2 weeks.This conversation took place in front of the lady from the dealership, that I had referred her to ( I had bought a car from them previously).After she had not paid me the money back after numerous attempts of trying to get it back, I called the lady from the dealership & she said that she would testify against her in court if necessary.2 wks ago she said she had the money, went to pick it up and her husband said that they didn't have it & just gave excuses.Now my daughter has to have an MRI done & we really need the money,so I sent her an email.Now she says that she doesn't know what money I'm talking about. How do I prove it?

First of all my child has insurance but her deductible had not yet been met. I don't know if you know anything about insurance or not but that's how it works. I was just saying that there are times that it would be nice to have that money back as it was promised. My husband is an engineer for the railroad and I just graduated from medical school so money won't be an issue in about 6 months or so, but it's the principle of the whole thing. I helped her out when she needed it most, after her car broke down on her with 4 small children. To me in my heart I don't know that turning her down would've been something I could've done with a clear conscience. I know that it may be stupid, but I would hope that if I were in an unfortunate situation as she was that I would have someone to help me out. I've learned my lesson, don't let friends borrow money yada, yada, yada, but I was just asking for legal tips or advice from people who have actual experience or legal expertise.

If the dealership ran YOUR credit card ... how did they return the money to her??? I don't think they have the right to do that...maybe talk to your bank about that. Ask them if that's considered fraud. Don't go into the whole story...just say I ran my debit card for my friend for a certain car and she returned the car and got MY money back. And write a professional letter to the dealership GM saying the same...with a c/c to the bank and maybe a lawyer you choose from the phone book. A dealership doesn't want problems for $500.00. Your probably going to hear this a million times... But even though the girl was your friend...ALWAYS GET MONEY LOANS IN WRITING WITH ALL TERMS AND SIGNATURES+WITNESS Signature. And it wouldn't hurt to hold something of theirs that's worth the loaned amount you get to keep if they don't pay up. Maybe from now on it would be best not to loan to friends... Have them go to a pawn shop or money loan place. Also Best advice to give people..If they don't have the money for it when they go to buy it ..DON'T BUY....SAVE MONEY UP FOR IT...

You have the debit card records showing $500.00 was paid to the first dealership, the lady at the dealership to prove it was your friend buying the car. Second they should have a copy of the refund they gave your friend...which she would probably have had to sign for. Then You know the dealership she went to second. Supine the paper work for the $500.00 she gave them.

Without some kind of document signed by her you are just out of luck...it will cost you more to take her to court than you can retrieve.. Chalk this up to a hard lesson, next time get an I.O.U. signed by the borrower or just don't lend money it's a bad thing, this person is a dead beat.

Learn from your mistake. Always get it in writting before you loan money if you truly want it back. Other than that people think of it as a gift and you will never see your money again. Never loan money you can't afford to be without.

talk to her face to face, have a tape recorder running in your bag and ask her why she cant pay you, get her to admit all the details. Theres your evidence.

go to the dealership with her and ask the lady.. so u can prove it!

you have your statement and you have a witness take your friend to court just that simple

you have nothing to prove, next time should be black n white. find debt collector to solve it.
