No, the photograph and its copyright belong to the photographer. He can not, however, use that photo in a publication for profit, such as a book, without your signed release. Now if the picture is of you burying your recently missing wife in the back yard, and he gives the photo to the police, you'd be hard pressed to find a loophole in that. If something occurs in the view of the public, then it is public domain. On the other side of the argument, if the photographer had to climb a three story building to get a view over your 16 foot privacy fence, you could argue Invasion of Privacy, as you were in a place where you had a reasonable expectation of privacy.

No, you do not. Purely and simply, it is the property of the owner of the film - usually the photographer or the company that the photographer works for.

In the US copyright laws basically say that if you take a photo those photos are yours for personal use only. If you intend to sell them or use them in anyway (such as a website) then you'll need to get that person you photographed permission to do so.

However, it is always best to ask permission first and also talk with a copyright lawyer when in doubt.

Absolutely not. Just because it's your private property does not mean that I can't stand on my property or public property for that matter and take pictures....Unless they are pictures of something criminal like your children running around naked in the sprinkler, (which shouldn't be happening anyway). In that case you wouldn't be worried about rights to the pictures, just prosecution.
