5 years depending on the state Ur in. As a norm it is 5 long years, sorry. I'm guessing 2 within 5 year time? They will go & serve 5 full years no good behaviour time. It's a F.U. law but it is what it is cause of MADD & joined DAMM. That sucks sorry 2 hear this. Missing court there is now a warrant out for his arrest & the bail bondsman (if 1 was used) is lookin 4 him. If that's the case he needs 2 turn himself in or it's goin to get worse. How anyone can slip through the cracks and be ALLOWED to drive after 2 drinking & driving charges is beyond ME....Sorry your daughter married a TOTAL LOSER.... he is costing her not only agony and dispair, but the financial costs of hiring a lawyer each time and paying fines is taking away from HER life as well. He is dragging her WAY DOWN into a pit she may NEVER be able to free herself from if she doesn't get RID of this loser SOON. He obviously has a SERIOUS DRINKING PROBLEM and doesn't care ONE BIT about your daughter or he would STOP and get HELP.... for a 5th offense, he probably will only get 6 MONTHS UNLESS he has already DONE some time for the 4 OTHER drinking/driving offenses... a SMART judge would give him at LEAST 5 years ( one year for each offense) and MANDATORY ALCOHOL REHAB THERAPY!!! But for your daughter's sake she should divorce this bum and not have to be responsible for HIS actions any more.

His sentence will depend on your state's laws, his prior convictions for DUI, the discretion of the judge, and who (attorney) represents him at the trial. Unlike Federal laws which have a set sentence that must be imposed, DUI is under the individual state to determine the sentence/fine and under the judge who hears the case to impose that sentence/fine. You may be able to find some direction at your state's Secretary of State's website. They may direct you to the exact law that covers DUIs and these other crimes.
DUI has very serious consequences, but by missing court and violating his probation your son-in-law has made this serious crime 10 times worse. He needs an attorney who has experience in this type of case.

It would depend on a lot more information and how long between #1 and #5 and how many attempts at rehabilitation. With that many in general, especially if under 10 years in between all of them, probably looking at a lifetime suspection of driver's license for being a habitual offender and a few years in jail, with a formula calculated for time off with good behavior, depending upon institution sentanced to.

,Wow that really sucks.... OK so the drunk driving is just part of it, he now has violation of probation and failure to appear, my advice is contact an attorney in your area that works on DUI cases, a public defender will not be able to help you.Then you need to get him to man up ASAP and get to court, tell them he has a problem ,try for monitoring and inpatient treatment if he does not walk into court on his own out of custody, you can guarantee prison for your son in law and if he shows up they will probably drop the failure to appears, witch each carry 2 years in prison, make sure he is employed that will help and for f*ck sake tell that son of a ***** its called a cab!!!! but for real contact an attorney, they can call right then and find out what you are up against for free, call a few, lay it all out they will be able to tell you what there experience has been in similar situations, tell your daughter I feel for her, and with a great attorney he should do less than a year if he takes care of it if not there is always Mexico.......

totally depends on the laws in your state. after 5 times, w/ fines, probation fees, and the like, your daughter is probably better off w/out him.

No problem. Here in America, as long as he's a total idiot, they won't bother doing much. He'll be out in less than a year, probably less than 6 months. He'll be drinking and driving again in time for New Year's Eve.

i don't want to come of as mean !!! but he needs to get locked up !! i lost a friend to a DRUNK DRIVER !! she was pregnant,at the time of the accident !! my friends fiance and his baby boy died. he got to hold his son,for 1 hour before he passed away,in his arms !! and the DRUNK DRIVER ? He is still out and about !! if he got caught 5 times,he needs to do some serious time!! before he too ends up killing, innocent people !!how would you feel if this happened to you ?? i don't mean to be rude,but it hurts bad knowing that i will never,see my friend again.
