im 16 and i recently elbowed (not exaclty a punch) a 17yr old in the face...reasons being 1. Sexual Harrassment towards girls much younger than him (next year he will be a sexual offender...he tells freshman hes a freshman..hes a senior), 2. Owed me a large sum of money and refused to pay it back. 3. is constantly high on drugs and unreliable. (and generally possesses marijuana at all times), 4. he tried to get my attention though nonviolent physical means even though i repeatedly told him to get his hands off of me. could he press charges? does what i have on him outweigh what he has on me? P.S this is in New York City

Elbowing someone in the face is Simple Assault. You can only legally use physical force against someone to defend yourself, and then only the amount of force necessary for self-defense.
Seriously, did you think an elbow to the face was going to correct all of his bad behavior listed above? Report him to someone who has the legal authority to do something about it, instead of getting yourself arrested.

I've always heard that germs that cause acne, rash, etc. can easily be transported through make-up products. Since you're almost never the first person to test, it is generally the reason every-one I know, applies it to wrists, elbows, and to the top of the hand for before deciding. Plus - after you're done trying, no-one sees it on any of those other spots, whereas having tried it on the face might leave traces of different shades when you leave the store.

Well hey im'ma letchu in on something, if u kno he's always high, he may not even be smart enough to press charges. But yes to answer ur question, u do have enough reasons to out weigh him, because for 1 he should've touched u, 2 he was high and could have hurt u, 3 dat fool might be 2 old 2 be putting his hands on u in the first place.
p.s Im n da N.O. and i would have kicked him n da nutts...

I would be surprised if this guy presses charges. Someone like this is not likely to stir up trouble for himself, especially in light of the circumstances.Matter of fact, if he owed me money and wouldn't pay it back, I would have a long talk with him about that weed he is holding.
And after warning him to keep his hands off of you, he deserves an elbow to the face.
Don't b*tch up. Maintain your ground and if the punk gives you any more ship, jack his @ss up again.

You're not 18, don't be too concerned about it.
If it was a simple elbow in the face because he was all over you, then tell people exactly that.

A druggie isn't going to press charges, anyways. If he's got no marks to prove it, he can't do anything anyways.

We don't know yet if he will be a "sexual offender" next year, but you're admittedly guilty of battery this year.

You asked about legality.

You're in the wrong (legally), because it wasn't self-defense . The "sexual harassment" was verbal? Then you can't physically attack him . Sucks for you now, but welcome to the adult world . You can't just hit somebody for being a creep & a jerk.
