According to the Supreme Court, in Hamdan v. Rumsfeld and Hamdi v. Rumsfeld (2004 and 2006), Bush ordered actions that are violations of Common Article III of the Geneva Conventions.

Federal law (18 USC 2441) makes any intentional violation of those articles a felony. The section is entitled "War Crimes".

Bush asserts a justification defense, saying that he is constitutionally entitled to perform those actions. That defense has not been ruled on yet, because (like all affirmative defenses) it can only be asserted at trial.

Only a FEW bad apple soldiers have committed war crimes such as torture, murder and rape. President Bush already TOLD you there were NO orders from superiors.
