Under the custody agreement, I notified my wife that I was taking the kids on vacation starting today. I bought tickets for me, my girlfriend and her daughter and my two kids to go to London for a week. Our plane leaves in two hours. My wife just called to say that she is in Maine and won't make it back until tomorrow.

Is there anything that I can do about this? I need some suggestions.

She has the children in Maine with her.

I'd suggest one of two things:

1. Go, regretfully, without your kids. Have a good time. Come back and tell your wife off for depriving your children of a great trip... after you talk to your attorney about getting the money back for the tickets that went unspent.

2. Let your girlfriend and her daughter leave. You stay back and see if the airline will give you different tickets (they should, although they'll charge you an exchange fee), and go a day late. Then talk to your attorney when you get back about getting the difference back from your ex.

Calling the courts, as suggested above, is not a bad idea either!

If you are leaving without the kids in two hours, you can make her pay for the expenses you have already spent on them to go. This is for the money that you lose and cannot get back from your trip. Since she was notified that you all were going and when to have the children there and she did not live up to this agreement, then she is at fault. She will have to pay for whatever you spent for plans for your two children, but if the whole family doesn't go and loses money, she will not be responsible for paying for the rest.

I would suggest you go to the Airport Check In Counter and make your check in and get in the plane with your girlfriend and have a good vacation. Check ins for International flights are three hours in advance.

You basically have 2 options at this particular point in time.

1. You can skip your vacation, stay home and file a complaint with the courts.

2. You can go on your vacation, and when you return file your complaint with the courts.

Talk to an attorney in either instance...he/she is the one who can best handle this situation.

It sounds like she's trying to sabotage your trip.

If she says she'll be back tomorrow, then change the tickets to the day after tomorrow (to give her enough time to get the kids back to you). Don't let her ruin your trip with your kids.

Go on vacation without the kids. Or book another flight.

She is in Maine or Is she in Maine with the children???? If it's just her go get them.

yes if she has been notified of your trip and the court knows then you can get the police involved as she is breaking an agreement
