If the father is illegal in the U.S. and Cared for the child for 5 years , and the Mother takes the kid away from the father?

I would guess you have every right she has. The bad thing is that sounds like you will need an attorney to have your rights established. Why didn't you file for custody when you had the child 5 yrs.? She wouldn't have been able to just walk in and take him.

I would say, he must be a legal citizen of the US before he should have any legal rights. Is the child a citizen of the US?
