we are being evicked after they accepted two monts rent and thired one returned is that legal

Like any agreement it is due on or before the date agreed upon. This is a legal agreement some landlords may allow a few days over but that is a gift but does mean you are still over due. Yes returning that third month is legal all you did and they did was bring your past amount current. If you stay there beyond when the next payment is due or even part of the month they can still make you pay up to the last day . They can also collect damages, cleanup, trash removal so leave it as good or better then it was when you moved in.

It depends on the rental contract and the laws in your state.

In many rental contracts you sign your life away ... you have no choice ... rent there and go by their rules.

Where I live, the rent is due on the 1st of the month.
If I pay on the 2nd of the month, there is a $ 50.00 late fee
If I have not paid by the 5th of the month, they can evict me.

I try to pay a few days before end of month, in case I run into some distractions, sickness, whatever, and especially if end of month falls on a weekend, where I might not be able to get into their office until the Monday after.

It probably is legal. There is no law about when they have to accept rent. It will be contained in your lease agreement. There are also several other clauses in your lease that allow your landlord to reject payment and evict. Read your lease carefully.

If you don't have a rental agreement with a lease then you are sol. The landlord can evict as long as they give you 30 days notice.

usually its the 15th

but landlords can do whatever they want passed the lease date
