If they live with him and they really are dependents then it's silly to say they are his parents because you can claim anyone as a dependent. If they are not his dependents then all the dependent exemption he has received for them he will have to repay.

He might or might not be in ANY trouble - he might be eligible to claim them if he provides over half of their support for the year, and their income is below the specified limits ($3300 for 2006).

If he's not eligible to claim them, then he'd have to pay back whatever tax savings he got from claiming them, plus interest and possible penalties. If he put "parent" on his return for relationship rather than "aunt" and "uncle", then he would have filed a false return and could face additional penalties. He probably would not be prosecuted.
