CPS called my house, they were rude to me, and they wouldn't tell me what they were calling for. they were asking me questions about my mom and her having a lawyer or not! I don't know what they were calling for! I don't know who the lady was! Please answer my questions!
Are they allowed to ask a child questions like this to children?
Are they allowed not to tell me what they are calling for?
Are they allowed to call my house and be rude to me?
What are the rules for them, i mean when they call people at there houses?

Tell them that nobody in your house talks to CPS without an attorney present. Then hang up! If they come to your door, tell them that they have to have a warrant or they can't come in.

Yea, CPS pretty much hires people who are not really professional, and do not have a clue as to how to properly handle questioning, etc.

Don't answer any of their questions. They are nothing but trouble, and will lie.

CPS has been directly responsible for hundreds and hundreds of cases of false allegations because of improper questioning techniques, etc. In Texas a few years ago, they were going to do away with them, but they hung on.

I understand they do have quite a bit of power, and can come ask you questions. If your mom answers questions, etc. I would do it in front of a lawyer, or make sure you have a tape recorder running, as they will not hesitate to lie.

And what is bad is many times they are not all that educated, and are making decisions, and assumptions that should only be made by a trained psychologist.

CPS, like anyone else, can call you at your home. They can even ask you anything they want.
HOWEVER,
you do not have to answer them. You do not have to give them any information. They are a government agency. Make them work for their information. You have constitution rights. ie, 4th amendment, 5th amendment.
Treat a CPS worker just like anyone else on the street. Would you tell a perfect stranger if your mother had a lawyer or not if they walked up to you on the street? What business is it of theirs.
If you do not wish to answer their questions, especially if they cannot be bothers to even come to your house, then hang up. If they come to your house though, do not let them in. (You waive your 4th amendment right and are consenting to a search). instead, ask for a warrant if they want to come in. You can simply state you do not wish to answer any questions and close the door. Sure they can threaten you, but that is their job to get information, adn threaten and lie is one way to get it. Do not give them anything.

You do NOT have to speak with them over the phone. You do NOT have to speak with them without an attorney.
No, they cannot question a child without the parent's consent.
Yes, they can call you, and yes they can refuse to tell you why they are calling. BUT, that does not entitle them to an answer.
Yes, they can be rude, and they can even lie to you.
There are few rules about what they cannot do. There are MANY rules about what you CAN do.

The employees of CPS have a bad wrap, every where I have ever looked, even the people that CPS has helped, I have found they are a very nasty group. You don’t have to answer any question you don’t want to EVER. I would say: "My mother doesn’t allow me to speak to strangers on the phone" if I were you but, its too late isn’t it.
