Yeah I know crazy I have a lady that lives up stairs from me and says that the insence that I burn bothers her and when I burn it to shut my windows. well first of all I dont burn them near the window and second I have lived here for a year and it has not bothered her until the past few days.. well she complained and now they tell me I have to shut my windows I dont see anything wrong with what I am doing. is against the law like isnt thier tenat rights please some one help me I am upset and it bothers me. thank you

Yes, there are "tenants' rights"....
Tenants each have the right to live in the space they pay for "unmolested" (meaning "not being bothered") and with certain freedoms.
That being said, you have the right to burn incense but the old bat upstairs ALSO has the right NOT to have to smell your incense.
And, did you ever think that it might be travelling up the air ducts into the old biddy's apartment?
Just suck it up, shut your windows, turn on a fan and don't put the incense in front of any of the air ducts.
And for christmas, wrap up some incense and some matches, ring the old bag's doorbell and RUN!

i just moved out of an apartment with an old bag living next door and everytime i turned my tv on it was to loud for her. she must have had bionic hearing or something cuz i could barely hear it. she complained about everything. no it is not against the law to have your windows open while you are burning incense. i loved burning them and if she didnt like it to bad!! sounds to me like you have a real winner like I had. (or should I say a real whiner) just make sure you arent doing anything outside of what the lease says. and if doesnt say anything about that the p.i.s.s. on her. and if she asks I would tell her no, you are not burning anything. cuz its none of her business what you do so long as you arent violating the lease!!

If your landlord says no, then the answer is no. The owner of the property has the right to deny the burning of candles or incense because of risk of fire.

I'm sure there are no laws regarding your issue. It's more of an issue of "I'm the landlord, what I say goes." Until you own your home, this is something you'll have to deal with. Whiny neighbors and dumb landlords.

She could have a claim against you for Private Nuissance. Yes, she can indeed stop you from burning it.
