before the event my nephew went in and got "measured", a month later the day of the event he was changing and noticed that the shirt was torn, pants were too big, vest was 10 sizes smaller and so on... when we returned the tuxedo the we explained the problem to the manager, she was overall rude and we felt disrespected, we didnt even get our deposit back. should i contact a lawyer and talk to him about it or just leave it?

Sounds like you're 'sue-happy'
When it was noticed that the attire was unacceptable a phone call to the vendor should have been made immediately. Did your nephew wear the tux anyway? Why wasn't the tux tried on/picked up the day before the event to avoid this type of last minute snafu?

I'd contact the BBB and notify them of the incident and make another attempt to get your money or deposit back - but attempting to sue seems a little extreme.

You would have to sue in a small claims court. However there is a likely chance you won't win due to the fact that you left the tuxedo shop with the suit and you didn't try it on in the shop. I would suggest you just drop it.

It's not worth a lawsuit in the least. There's nowhere near enough money here to retain an attorney.

Sounds like a bad rental place. Keep that in mind for the next time one needs to rent formal wear.

The most you would get is the rental fee...why don't you call and see if you can get it credited to a free future rental or a refund.

It's far less hassle.

YOU DO NOT NEED A LAWYER--FILE AN ACTION IN THE SMALL CLAIMS COURT IN YOUR JURISDICTION--MAY COST A COUPLE OF DOLLARS--THE TRICK IS IN PROVING YOUR CLAIM. LAWYERS ARE GENERALLY NOT PERMITTED IN THIS COURT SO YOU ARE ON YOUR OWN.
