South Carolina requires a one year seperation.
apparently that starts over if you spend the night there even if it is in a different room of the house and no sex took place.

they filed for divorce 2.5 years ago however they "1 year" was started over due to her trying to remain friends.

she wants it over... he doesnt
and he refuses to go to court and say it has been over a year as late last year she was forced to stay there (in a seperate bedroom, no sex) due to a very severe storm.

she needs to know what would be the risk involved in saying it has been the year under those circumstances.

she has him realizing it is over and therefore he has filed for the divorce. but he is worried that will come and bite him.
HOWEVER... sure certainly is not going to rat him out.
any experience or knowledge regarding this would be very appriciated by her.

you gotta make up ur mind.....i think its been too long....shud get over with it & carry on with life.....you don't kw whats in store for you next and you'll never know till you take a leap of faith.

I'd get a lawyer and ask this person, this would be a smart thing to do. Good luck to her, I'm going through something similer here in IL. He doesn't want it over with so he can control me, I've been in court for two years now, no end in sight.

If She wants it over she should have never spent the night ..and he best not lie about it becuz she can, and probably will use the purjury against him to get what she wants .he needs to wait it out for the year and get an order of protection against her if possible" will make him look better in the long run" SHE WILL RAT HIM OUT!!! DON"T TRUST IT!!

i heard it was faster there ick
i know someone who said 1 yr in court and the judge believed it even though it hadnt been...alot of times ppl end up with living sith someone new out of frustration..
adultery is rarely grounds for divorce anyway...its usually about money and all that..

If he doesn't want it over then he is not going to lie about the length of the separation.
