ok is it rue that when your biological father leaves there child for over a year is it legal abondenment? and if so can you be legally adopted by your step father without any problems

you still have to obtain the paperwork signed by the biological father. Use a little leverage, tell him if he signs, you won't go after back child support. Otherwise, your gonna go for the max you can get.

Legally you can't adopt a child with out going through some legal process, unfortinutly the bio parent even if they are not in the childs life still is considered the bio!
Not really legal abondment, does this child live with the mom and you are a new husband , abondment would be like this a person dropped the child in a mall and took off and never came back, if the child was with the mom it's not abondonment in the legal sense. However the mother of the child could take action through child support enforcement agency to enforce child support.
First of all you need some legal advice, go to legal aide in your area to see if they can help you start the process, you will have to serve the leagal parent papers or attempt to contact them, if you can't you have to pubish an ad for 30 days in a local newspaper, if every attempt is made to contact the bio parent and it all fails, a court will allow the adoption to proceed.
Of course be prepared to be checked out yourself, most likely they will dig into your past, present, meaning don't have any hidded skeltons, be open and honest about any legal sitations you may have encountered!

Statutes don't necessarily provide a time period to define abandonment, but often base the finding of abandonment on evidence of an intention not to return. If you had a good lawler to do the adoption I sure they could find a way around it by proving his intention to not return

No, the biological father will have to sign. Every attempt should be made to find him.
