I have a court order & have a case balance of almost $16,000.00. The DA is of NO help! As long as there is a payment withing 1 year, they say there is nothing they can do as the case doesn't default to a criminal case until there has been no payment for 1 full year. I may get $50 a year & that's it, but because it's something, the DA wont do anything to persue it. I know where the father is, know where he works, & give all this information to the DA. Once everything is in place to get a wage assignment (which takes a good 3 months with the DA) & the money is taken out of the father's 1st check, he quits & gets another job. So it starts all over again. There has to be someone or something out there I can do to stop the injustice that is being done to my daughter. I don't care about the money. It's not for me, it's for her. Does anyone have any suggestions????? THANKS!!!!!

I hate to say it, but....go on welfare. That changes the DA's opinion REAL quick.

Case in point: I got behind on my child support (100% my fault). My ex went on welfare and suddenly I had both the states of Kansas (where she lives) and Texas (where I live) all over me about it. I got caught up, but it took a while.

Contrast that with my new wife. She's a nurse, makes good money, and her ex-husband hadn't paid a dime in child support. She even spent $3000 of her own money to fly back to Mississippi (where they were divorced) to take him back to court, where the judge told him "if you have $20 in your pocket, $15 of it goes to your kids".....and STILL hasn't got a dime from him.

If it costs the state money, they care. If it doesn't cost them money, they don't care.

Injustice is depends which side of the case you are on. $16000 child support in one year makes your ex a high income guy. Must be something you did or the system did that has made him angry. Unfortunely he has no rights to his kids or to his paycheck once he comitts on having his wages garnished. Since you care so much about your daughter can you put down the fighting and maybe work out joint custody where he spends half the time with her? I mean it's not the money.

If you did go on welfare they would go get him arrest him and make him pay because the state doesn't want to pay. You also can make false claims of abuse against him but what good would all this do for your daughter? It would only get a lot of money into the house if your ex is a good income maker!

Even after a court order is in place and the father is still not paying child support there is nothing you can do. It sucks but that is the way it is, even though it is illegal. Look at it this way, you could easily place a restraining order against someone and they could just as easily walk right through anyway even though its in writing. If the DA want help, I dont know what else you could do! It may be the law, but people break it anyway! :(

What state do you live in? Most child support collections go through a division of child support enforcement. I'm puzzled as to why you are dealing with a DA.

Go to human resources and ask about AFDC-- Aid For Dependant Children, you could get the state to pay you child support and they would get him for the payback.Tell you story to them.Good Luck
