we have a family friend that is divorced, who found out that her ex husband new wife is a registered sex offender, the problem is the friend has 3 boys under age 10. and the new wife and husband want custody of the boys, my question is, will a judge order the ex wife to let the boys go with the husband and his new wife to a new state even tho she's on the list, even tho the new wife says she's stayed out of trouble is it still possible?

Just to let you know in some states if you get caught for indecent exposure they make you register. That may not be her case but I would find out what it was for before you start reacting in a wrong way.

It is a factor but not a BIG factor as you might think. Depending on which state, most of the time the kids goes to mommy even if the father has a ton of money.
However the new wife cannot be kept away from the kids because she married the father. The court sees things differently than everyday people. They look at your situation through rules and guidlines , not through emotion. Just because she was convicted of a sex crime doesn't prove that she did the crime. She could have plea bargained and most of the time 90% plea bargain occurs in courts due to the cost and possible incarceration.
If, NOW..IF she has a stay away from kids filed on her then thats whole different story. She has to stay away from the kids. But, if not then she has rights. There are a lot of things that can vary in these procedures. But, most of the time its difficult to fight a case like this because of stipulations.
Contact your DA's office and find out what the stipulations are!

If the new wife is a registered sex offender, the ex husband cannot get custody. Regardless of whether she's stayed out of "trouble." Remember it's in the best interest if the children. Sex offenders are obviously not in the best interest whether male or female.

I doubt any Judge would allow them to have custody if she is in fact a registered sex offender. To be registered as a sex offender, I would imagine she has in fact been found guily of something. In any rate, with thinkgs like this, dont fool around, make sure you have a lawyer

just tell your friend that they need to make sure that the judge knows that the new wife is a sex offender. The judge shouldn't order them full custody, in fact, he shoudl only order supervised visits with this evil nasty perverted woman.

in case you're convicted of a intercourse-correct offence, the court can order which you're placed on the intercourse offenders register. it is the only way you may formally be considered a "intercourse criminal". that does no longer imply which you won't be able to be convicted of a intercourse-correct offence and not be placed on the register - it is as much as the court.
