ok, so heres what happened...i took my little sister in law to the mall, we seperated, WENT OUR OWN WAYS, and well about an hour later, we met up again (in mervyns) she had a cart full of clothes, and other misc stuff, i asked her why she had all of it, she said she was just getting clothes to try on,so i go upstairs, and about 15 minutes later i run into her, no cart, just 2 big bags full of clothes,well i automatically knew what she had done, and i noticed an employee looking at us funny, so i told her to put it back, i wanted nothing to do with it, i wasnt gonna get into trouble for her,she refuses, so i get onto the escelator as i watch her head for the exit,she gets stopped by LP,i knew she was gonna get caught,so i try to exit and i get stopped, well inside the office, they said they were gonna charge her for theft, the total came up to $824,the police were called, i was tol by LP i was NOT going to be charged because i didnt walk out with anything..so i was happy i wasnt in

trouble,i decide to wait with her, while the police were called, because it was late, and i was her ride home. The cop arrives, asks who i am, (oh and i had my 2 children with me) i said i was her sister in law, and was just waiting with her so i could take her home (she needed an adult with her anyway) so he asks LP if they are charging me, they say NO, SHE DIDNT STEAL ANYTHING. the cop asks, well was she with her in the store at any moment? they say yes, for a brief moment we were talking, cop assumes i was in on it, and i get charged with a THEFT 1, which is a felony (if its over 750 its a felony) it makes me mad cuz i was given the choice to leave, and i stayed to be there for my little sister in law..think i could get out of this? i DID NOT steal anything, they checked my purse, my bags, saw all my receipts, what do you think?

i forgot to add, i was arrested in front of my children for this! i was only cited and realeased but i just feel im INNOCENT!

if you have been charged, get a lawyer! do not read another post on here.... get a lawyer and talk to the workers/manager at the store who was there that night. get their story and if possible have the lawyer help you with that... (i.e. getting them to speak on your behalf to the judge that will hear your case). GET AN ATTORNEY!

Just because you were not held responsible for what your little sister-in-law did, does not mean you did the right thing. Some people, not all mind you but some, would have felt a moral responsibility to prevent this from happening to the girl in the first place by insisting she not exit the store with the clothing.

You did what most people in your situation would have done, which is not always what is right. The truth is the best thing would have been for you to tell her that you would have to tell if she went out without paying for her stuff. I doubt I would have been able to do that either. If your sister in law has any morels at all she will tell the police it was all her and get you out of trouble. We all need to remember the jails are full of those who just went along.

When this goes to trial, try very hard to get the person from the store to testify. Your sister-in-law should be punished for what she did, you tried to talk her out of it. The store didn't want to press charges against you, yet somehow you ran into an over zealous police officer.

You didn't go your own ways IN MERVYNS, which is why you're lucky not to be charged as an accomplice.

sometimes it is hard to know what to do kids shouldn't be shopping alone, but maybe you could've squeezed her ear a little bit and caused her to drop the bags and leave them right there, and make a scene.

get yourself an attorney...sounds like a tough situation.
