U.S. District Judge John D. Bates dismissed the case on jurisdictional grounds and said he would not express an opinion on the constitutional arguments. Bates dismissed the case against all defendants: Cheney, White House political adviser Karl Rove and former White House aide I. Lewis "Scooter" Libby.

Armitage is the person who leaked the information - its well known now that he cut a deal with the prosecutors to help them get Libby. The prosecutors had no real case since her classification was not considered secret when he outed her - but he's the one that did it and they don't sue him?

Is it because he was a Clinton hold over?

It didn't fit their "Use misdirection and dazzle them with bullshit" strategem, so they left him out.
