My previous employer never took Federal out. On my W-2's every year it was never listed and I always owed the government. Is that legal? Could it be that it was because there were a lot of illegal immigrants working there too?

All I ever did was fill out an application I never filled out a W-4 or whatever.

She only took out for SS not any kind of Medicare or whatever. Out of like a $400 they would take out like $15 or so

If you always owed the government at the end of each year and your employer was not withholding any taxes, then more than likely, they were not following the proper regulations, especially if they were providing you with a W-2 every year.

In the U.S. Code, TITLE 26, Subtitle C, CHAPTER 24, § 3402
"Except as otherwise provided in this section, every employer making payment of wages shall deduct and withhold upon such wages a tax determined in accordance with tables or computational procedures prescribed by the Secretary."
There are very few exceptions.

If you were an employee (and you were if you got a W-2) then yes, they were required to have you fill out a W-4 form, and withhold income tax as specified on the W-4. I assume they did take out social security and medicare - that's also required for an employer for his employees.

If you worked as an independent contractor, you'd have gotten a form 1099-MISC showing your earnings, and not had any taxes deducted, you'd be responsible for paying your own including social security and medicare. If you got a 1099, you would not have gotten a W-2.

I suppose that an employer who was already hiring illegals wouldn't hesitate to commit another legal offense by not taking out taxes properly.

And by the way, osto11's answer is NOT correct.

It's YOUR responsibility to pay taxes not your employers. You can request the employer to give you a W-4 (the federal form given when you are hired), which they already have. The employer is not responsible because the IRS comes after YOU if your taxes aren't paid. Just as it's your responsiblity if you claim "exempt status" or claim "1 - 10 dependant withholding" on your W-4. If there are alot of illegal immigrants working there, leave them alone and let them work or if you are a (Radical Republican) call ICE.

No companies are to take taxes out of your pay, even if they do depending on what you claimed on your w-4, if you claimed excempt or how many excemtions you claimed will determin the amount taken out, you might still owe taxes if enouph taxes where not detucted. You should contact the IRS
and report this company.

Illegal Immigrants has absolutely nothing to do with not having federal taxes taken out. It is probably because you didn't make enough money for there to be taxes taken out. My husband hasn't had taxes taken out of his checks since 2003 because he doesn't make enough money.

Your employer can only take out taxes on your paycheck based on the w4 that you filled up.

I think you can sometimes decide how much they take out

it could just be they went with 0% and then later you paid

else you can do higher percents and they will give you a larger refund

you have to pay sooner or later though!
