Probably not but good try, kind of like when I totalled my car going 60 through a neighborhood said I saw a deer so I swirved took out a tree and left my car in some peoples yard at 3 in the morning while the horn was going off to by time to sober up, cops didn't believe me but passed the field sobriety tests. So no DUI.
