There is a lawsuit and everything happening over this very real incident. Do you think that students (attending public school) should be enforced to wear uniforms? If so, or if not, please discuss the reason for your answer.

Without thoroughly researching the issue, my sense is that the public school cannot mandate a single uniform (even though general dress codes are allowable).

Dress is a generally recognized form of expression. And under current constitutional interpretation (even with the Roberts court gutting 1st Amendment protections last month), the school must still show that restraints on student expression are necessary to prevent disruption of the educational environment.

Since countless other schools around the country function without a mandatory uniform, the school will be hard pressed to show that the uniform requirements are the only way to avoid disruption. Hence, they probably cannot meet even the reduced burden of intermediate scrutiny that would apply.

The public schools are run by the school board, which is an elected body, like city council or Congress. They make rules to reflect the will of the community, as expressed by the voters. It would seem to me that the people opposed to this are in a voting minority.

It is not unusual for school systems to have some kind of dress code, because they want the kids to look decent, according to some set of values, to not wear gang insignia, not wear certain kinds of religious insignia, and when there is great disparity between economic classes, make it more difficult for the children of rich parents to prey upon children of poor parents, where their clothing is not so great.

because they want a non-religion secular society

that question has been around since time began. what is the problem with it, that the school have to bring dress code. Is it to protect the teachers and or students. today citizens as a whole take colours you wear mean that you belong to a certain gang or organization. The clothes show the class you are in. sometime they dress like their favourite singer.But this way they can go to school and learn what the person is real like.or are we just like to think we are better than them. when it come down to it to have power over another human being is what this issue is real all about.

You go to school to learn. Not set fashion trends. Boo hoo you might have to wear a uniform. Deal with it. Life is tough. Maybe if kids weren't killing each other for their tennis shoes uniforms wouldn't even be an issue.

It is indeed legal as all students are treated equally. The only legal avenue is if some item of religious observance is banned: such as a yamucha, a veil etc.

Many urban school have uniforms/dress codes to prevent gang identification, and other negative stuff.

There is No constitutional right protecting you from laws requiring a dress code.

If that's what the parents want then yes, it is legal. It's also a darn good idea.
