She lived alone and was deaf. She died three weeks ago but they didnt find her till a few days ago. She is sitting in the morge cause no one can claim her.
We know she has a brother and two very close friends that she would leave a will for but the police/court wont let us get into the house to get a phonebook since we arent family. The closest family is in New York and they dont know cause there is no way of telling them.

Anyways What do I do to One claim her and give her a funeral and two find her will and make sure her money and estate goes where she wanted it to go and not the state.(I know she had a lawyer but I dont know who)

Please accept my condolences for the loss of your friend. There are advocates who work for the police and for the coroner, who will be able to help you. Legally they can't turn the body over to you or show you the dead person's documents, but I'm sure that they would want the next of kin to be notified as much as you do. Call the police or the coroner's office, even the county, to find out who to talk to, and get them to look up her next of kin and notify them.
If that doesn't work, try a local assistance group for deaf citizens -- maybe they can help.

First of all, the police would know if this person had family or would attempt to find the family. Once they are contacted then they will need to claim the body and belongings. I find it hard to believe that they would not let someone identify the body. My question to you is...if you are such a friend why did it take you three weeks to report or for them to find the body? If you were a friend to this person you would have know something wasn't right three weeks ago.

Unfortunately, it is a family issue and her next-of-kin must somehow be notified. Perhaps once her family claims her remains they will allow you to hold a funeral for her. Her money won't go to the state unless she died completely without a will which will provide for her wishes at this point. The police will have to retreive her phone book and contact the brother, that's their job.

What I'm going to suggest is illegal, but in this case, the state's interests can go to Hell. Quietly get into her house at night (break in if you have to), find that phone book, and leave. Then, call the woman's next of kin, explain the situation, tell them what you needed to do in order to get the phone book, and let them handle it from there. Considering that you and the woman were close, the next of kin might ask you to act as her executor. It's better than letting the state handle it, because if they do, I guarantee you, the family will never get any word or assistance, or any of her heirlooms, or her home, until the state has milked her estate dry and siezed the home for sale at auction.

Her next of kin are the only ones who can claim her body. You are not next of kin and therefore have no rights. If she has a brother and you can get in touch with him, that should be done right away so he can get in touch with her parents.

You might want to consult a probate attorney.
