Yes your landlord can evict you for non payment. Most landlords will not evict if you can provide some proof that you will be able to pay next month. I have been a landlord for many years. First call and write to your landlord and explain your circumstances. Try to work out an agreement. Also check with your Attorney Generals office for a booklet on Landlord / Tenant rights. Every state is a little different. I am in Minnesota and the law here states that a landlord can start the eviction process if you are ONLY 1 day late. Rent is usually due on the 1st day of the month. The landlord can start an Unlawful Detainer action or called an Eviction Action Complaint. Usually takes 2 weeks to get into court. If you bring the rent money on the court date and the fee for the Unlawful Detainer ( $248 in MN ) the landlord can reinstate your tenancy.
Remember most landlords have bills to pay and that is why they are strict about rent being paid on time. Talk to him first, but get an agreement in writing if you make one. Good luck.

Landlord has the right to refuse partial payment on rent. The best thing is to let her know your situation and the coming unemployment benefit. I hope your landlord will understand and give you a break. However, for those who don't understand you will be facing eviction. Plan B is = In the meantime check out to see if you can move in/or pay your friend to stay with them for the time being with the money you put aside for partial rent. Plan C = rent a room instead of renting the whole apartment until you are getting back at your feet.

In most states the landlord can evict you after three days of non-payment. However this is an expensive proposition for him. It is highly likely that if you talk to him about why you cannot pay rent, and let him know when exactly you will pay it he will understand and give you no trouble.

Different states have different laws pertaining to the eviction of tenants. In Virginia-- there is something called the VTLA (Virginia Landlord/Tenant Act)...
My suggestion would be to talk to your landlord-- let them know what the problem is-- then pay what you can-- and pay the remainer shortly thereafter.
Everyone can fall on hard times--- The difference between the outcomes-- are how willing the people are to communicate.

It depends on the laws in your state. In Vermont you can be one month late three times a year without the landlord being able to do a thing. You can find the laws and codes of your state online. And in most states only a judge can issue an eviction notice, not the landlord.

Quick---go talk to your landlord and explain the situation...see if they will work with you. If you are a good tenant or a long time tenant they may want to keep you and be willing to work with you versus having to go through the evict process, clean and rent to another person.
if they do decide to not work with you...they will need to give you a 3 day notice to quit o or pay. If after 3 days you do not pay or leave...then they go to court and file against you.
try to work this out...as you do not want an eviction on your credit history.
good luck

Yes your landlord could evict you,but he has to give you something in writing and allow you 10 days to pay before he makes you actually moveout. Also, if you have a good landlord and you go talk to him/her they may wait for the money and just add on a late fee to your rent.. If I were you I would talk to the landlord soon about it. GOOD LUCK!
