She claims she's never even heard of the song "I wanna be your boyfriend". I believe her. I'd never heard of it before the lawsuit was filed, and I'm old enough that I should have if it had been anything of a hit.

I just listened to both songs again and again and again...I really don't see enough similarity to make the claim that she stole the song, sorry.

It's a valid lawsuit. Like someone else said, the Rubinoos song didn't have to be a "hit" for them to be able to lay claim to the rights to it. They wrote it and put it on one of their albums.

I've heard of the Rubinoos, but I grant that they are a pretty obscure group. I definitely believe Avril Lavigne never heard the song or heard of the group. She's shown to be pretty ignorant of music in the past. Her co-writer or someone else working with her probably HAD heard the song before, though. And even if it's an unintentional rip-off, it's still a rip-off.

Either way, her song is lame. She should be sued for crimes against music.

You are assuming that a song had to be a hit for Avril to know about it and for the lawsuit to be valid. That is simply not true. If you were NOT a famous song-writer and someone heard and stole your song, wouldn't you especially be interested in suing? It was YOUR song!! It could have been your claim to fame, and it was stolen! Doesn't matter if it was even recorded yet.

I'm not saying they are telling the truth. But the truth is that many famous singers have stolen music, and were rightfully sued. In your defense, however, many people claim their song was stolen in order to profit off of someone else's fame. Your liking of Avril Lavigne does not make her innocent, no more than her being famous makes her guilty. That is what the court system is for. So I don't think it is ridiculous at all. That said, the Rubinoos will have to PROVE they wrote the song. That is a hard thing to do... especially if you ARE lying.

Those 2 songs are WAY too similar for her to never of heard it. They lyrics are just different enough to where she might win the case, but come on.. how can she make a song so similar and then claim that she never heard it before.

When George Harrison ran into problems with his "My Sweet Lord" there were a whole heap of people claiming never to have heard of The Chiffons "He's So Fine"

Recording artists are presented with songs by their "people"' all the time, and I'm sure this is what happened to Avril in this case. It's a blatant ripoff, someone in her circle knew it, but I don't think that means she knew.
