After I put a stop payment on a check the bank let it go through, resulting in 7 overdraft fees!!! Now they refuse to credit me the overdrafts.

I have climbed the ladder to the point that they won't return my calls
Where can I go


The bank by the way is National City and it's not the first time this has happened

Report them to the Better Business Bureau.
Report them to your state's Banking Commission.
File a consumer complaint with your state's attorney general's office of consumer affairs.
Put everything in writing. Send copies to the bank's VP of Customer Relations.
Then close you account with them.

I don't know how much money is involved, but if the amount in dispute is under the Small Claims Court limits, file a suit there.

Also contact your state's banking department. They might help.

The problem is going to be that most banks give themselves an out if a stop payment is ignored. They can claim it was too late to do anything about if. It is now common for banks to pay checks electronically without the physical check having to be presented to the paying bank. In this system a check can clear the day it is received.

See if they operate under a state or ferderal charter, if they have the letters NA after their name it is a federal bank. This means you have to file a complaint with the federal banking authority. If they are a state bank file a complaint with the state banking commission-good luck

That sux!!! I would make copies of the stop copy form and copy of the check and the statement showing that it still went through. Get ahold of their corporate office or even go as far as getting in contact with the better business bereau.

I would not let this matter go unattended. You have a right to your money.

you need to have proof that you stopped payment before the check was submitted to the bank. but if this has happened before and they are unwilling to correct it take your money and go somewhere else.
