A pretrial hearing need not be immediate. When it's scheduled is a matter of state procedure - each state varies.

In some states there can be a pre-trial hearing very quickly after arrest, to determine whether probable cause exists to bind someone over for trial (in some states it's actually called a probable cause hearing) and in others it's some time later.

And whether they're out pending trial is a matter for a judge, usually at a bail hearing - they can be released either on bond or without bail.

It could be because that's the courts next available Pre-Trial date!

This also allows you ample time to contact an attorney and have him/her prepare for any issue they wish to address during pre-trial proceedings!

Best wishes.
