A fifteen year old girl calls and holds conversation with you for a week.The subject refers to alot of topics,including sexual questions etc.She asks for your description and says she'll do it if she can cut your hair.Her mother drops her off,she's lied about your age and it happens.The thing is,she is never hurt or abused but a month later a cop knocks on the door saying that you sexually abused this girl.The age difference is twenty one years.Since this is a hypothetical question,what would you do?Tell your story to clear it up with the detectives?Or go for a jury trial?

first you sound like a douche bag but theres a 21 yr difference and you didnt think to ask for id ?
get a lawyer and say nothing as I would always suggest; different states have different ages of consent i believe but often with parental consent but all i would say is
LAWYER!

Just to make sure I've got the facts;

1) she's 15. If you knew this beforehand, it doesn't matter what your story is - it's statutory rape, or whatever your jurisdiction calls it. If you didn't find out until afterwards;

2) the age difference is 21 years. Even if you didn't know she was 15, that 21 years should be pretty obvious. What the hell were you (hypothetically) thinking? Even if you guess that she's 17-18, that still puts you mid-30's. The word "predator" comes to mind. The detectives won't care what the story is. The jury probably won't either.

3) her mom drops her off. Sounds like social services is going on overtime for this (hypothetical) case.

Hypothetically, of course, the accused in this case is screwed. The best he can do is plead gross stupidity and hope the jury is stupider than he is. Maybe someday he'll be able to take some time and start thinking with his upper brain, rather than the one that got him into this situation.

Someone that is 21 years older then a girl of fifteen should be smart enough to see she was underage, unless they are truly stupid! They would have no choice but to face charges in court, talking to detectives would surely incriminate them further since what they say can be used in court-shut up and get a good lawyer.

This is statutory rape. It is illegal in all states. It doesn't matter if the girl was willing or not. If intercourse occurred, the charge is rape.
