My friend got fired from her job, she thinks it was for discrimination. What can she do?? In Ca.

She needs to contact the US Equal Employment Opportunity Commission.

It is very hard to prove discrimination. Sometimes what looks like discrimination is just business. Many older workers are let go every year and it might look like it was because they are old but it could be that they have been on the job a long time and are higher salaried than younger people so when they cut staff they are first to go.
Age discrimination is the most common since people start younger than they are later. Gender and race are know when you are hired so if they didn't want you they may have just not hired.

There is a difference between thinking and knowing it's discrimination.

If she can prove that other people of her race, or age, or whatever have been let go recently. She would have a case.

As long as she has not been fired for gross misconduct (like stealing or something) she will probably get unemployment compensation.

Most people are fired at least once in their life. Help her get over it, and get out there and start interviewing again.

There are a million reason why she got fired, probably because she sees discrimination everywhere. Maybe she just wasn't good at her job,maybe she was a pain in the butt. Just because she was fired doesn't mean it was racial. Get over it and find a new job.

She has a right to now the real reason she was fired and she should get that from the Human Resources department.

If there were accusations and she was fired because of that, she could sue for wrongful termination.

If she was fired for cause and they have paperwork and testimonials about her guilt, she still has the right to sue.

If she was fired for documented poor performance she could sue.

She has all these rights but before going ahead with suing her old employer, she better be sure she has a strong case and not just hurt pride. It could ruin her chances of getting another job.

It's strange. The company normally fires someone who is not productive or hampering the company's image. Your friend needs to find out the reason behind this.

First she should file a claim for Unemployment Insurance Benefits, then she can call or go to the labor departments web site and file a complaint, if there is enough evidence they can investigate and take appropriate action.

She should find out exactly why she got fired, and take it to court for discriminatory reasons if it was purely out of discrimination.

in ny the employer does not have to give a reason for termination. if they do then they have to be able to prove it in court. my friend is there now sueing his former employer for the unemployment due him as a result of wrongful termination. his lawyer said that he has a case only because the employer said in writing on his termination papers why he was terminated. if they didnt, his lawyer said, then he would not have a case. his lawyer also said that the employer is not requierd to give a reason for termination.

Get over it or go back and ask as a freind exactly why she was fired because it's not fair to get fired without an explanation.
