because we are always late. as we always do gave the rent to our on site manger who is saying we never did. she has since been fired or let go because other reason discrmation drug selling,and makeing racail slurs.. we have a recpit what do we do now we have to go to court for unlawful detainer

You can not be put out without a 30 day notice.

Wrong answers. A 30 day notice is required for termination of a month to month lease. However, when rent has not been paid, a "three day notice to pay or quit" is served. If rent is not paid in the three days, then the landlord may proceed with the unlawful detainer to eviction, which does take time, but has nothing to do with a 30 day termination. Non-payment of rent triggers the 3 day notice procedure.

As long as you are current on your rent then they can't do anything unless they have other reasons.
The 3 day notice is to pay or vacate the permisses. If you have not done either in 3 days then they have to go through an eviction process that takes up to 30 days.

You have 30 days to vacate on a month to month. 2 weeks is the fastest I have ever seen an eviction. The only way he can get a three day order is if there is a threat to the property, like you are runnning a meth lab or something. Definatly talk to a lawyer.

I think all states are different on this law. Do you have minor kids in the home? If you have kids in the home, it may make a difference in the time you have to get out.
