My wife switched jobs last month. Anyways, 2 wks later we got a paycheck for the company she left direct deposited into the bank. It makes sense since most employers hold back 2 wks pay. The payroll office called her up today and said that she should not have received that paycheck. Since her account was setup for direct deposit do they have the right to pull the money out of our account? Is it legal for them to pull back a paycheck that has already been cashed or should they have to present evidence that the paycheck isn't valid? any thoughts would help.

The thing is that it wasn't the same day. She got called about it today, but the check was in the bank last Thursday.

This happened to my fiance and his former employer removed the money the same day that it deposited. Pretty sure it's perfectly legal.

A lot of times in the paperwork you sign to enroll in direct deposite, it includes an agreement that they can remove funds incorrectly deposited in your account.

That's not right. They made that mistake and they should deal with it and not do anything to her. Good Luck!! That should be illegal.
