I'm currently taking a summer class of history, and I was wondering if it's illegal to record the lectures in class. I was talking to my friend about how I'm going to record my classes so I don't miss anything, and all of sudden he says, "It's illegal, you know."

It's for personal use, and I don't intend to sell it or share it. It's just for me. Any answers will be appreciated.

And if it isn't illegal, do I have to ask the teacher to see if she's okay with the recording?

You must ask permission first or it may violate copyright law, not to mention wiretapping law. Most professors will agree to it, especially if you tell them you would like to listen during class and make notes later. However, some professors won't let you because they think you will share it with others. Also, some universities have policies against it, so you should be aware if you'd be breaking any university/school rules that could result in disciplinary action.

I can think of no law that might prevent it...[copyright protection? ], but it's up to the instructor to allow.

With permission of the instructor -- legal.

Without permission of the instructor -- illegal. (common law copyright violation)

Nope, I know of people who did it. But you usually have to ask the professors because sometimes they don't allow it. Best of luck!
