My parents divorced at around 6 months. He is supposed to pay child support but barely ever does. So he still owes a lot and Im sure he'll be paying it off until I'm like 30. But how do I get it sent to me instead of my mother? She is using it for other things. I dont live with her anymore because we didnt get along and she would kick me out a lot. Its been really hard and knowing she still gets my money makes it harder. She has a nonprofit job so she doesnt make barely anything sometimes.. and she uses that as an excuse to keep part or all of the money he sends. it doesnt happen often and it isnt that much, so when it does happen I really think I should get all of it. Like if $200 is sent. She'll give me 50 and my (25 year old) brother 50 and keep 100 for herself. I'd understand IF i was living there and benefiting from the money she kept. Like if she used it for groceries.. but she isnt. she keeps getting all this new stuff and saying she's broke.. how can I change this?

also, dont know where my father is so i cant talk to him about it. he sends everything in mail with no return address. havent known where he is in over a year. and 8 years before that.

If you lived at home until you were 18, the money is hers. If you moved out before that, then I guess you should calculate how much money should have been given to you. So if you moved out at 17 you would have up to 12 months of support (depending on when your birthday is and when you moved) that you could claim since you didn't live there, but if you were there until 18, it's all hers. All the back support is more of a payback now, instead of maintenance. The child rearing is over, now the money that comes in is repaying money already spent on your behalf. Honestly your mother is generous to give you any of it if you were there until you were an adult.

Cant since you were a ward of your mother when they divorced she was responsible for your upbringing so the courts awarded the child support to your mother and not you as written in the divorce decree, and there is no way for you to change that decree. Its upto your mother what she does with the money. And only your mother can take your dad back to court for non support payment; breach of the divorce decree

you have to go to the dept. of children and families and talk to some one about this... that money should be going to whomever has the custody of the minor or to the person it self. You might have to go to court also and file a petition so a judge can change this, it varies by state

YOU don't get the back child support. That is money owed to your MOTHER for providing a roof over your head, food in your stomach, clothes on your back and a place for your to sleep while you were growing up. You are on your own and are owed nothing because when you were growing YOU were not providing for your needs, your MOTHER was. Suck up and deal with it.

she gets to keep it who do you think paid all the bills the whole time he wasnt paying? HER !!! she most likely put her needs aside while he wasnt paying and spent it on you, now it's her turn to enjoy something after all the years of having no money. If you were my son and acted like that was your money I would smack you. Give your mother some respect

Have you talked to your father about this? It's child support, to support the child, you know... If you haven't approached your dad about this, I suggest you do, he'll send the check to you and your brother instead of her, and he is also entitled to knowing where his money is going to.

Have your dad take her to court about it. Or maybe you could call the child support office in the city you live in and explain to them what is going on.
