I would say it isnt legal because of that BLIND SPOT -- soooo many accidents in MT happen that way-- we had this IDIOT do that last week while driving a motorcycle- he lost his legs now ..
and the people in the other vehicle were killed!

Having traveled most of the country I have found this to be true in most states: On multi-lane roads either slow traffic must keep to the right OR the left lane is only to be used when passing slower traffic. These rules seem to be largely ignored by drivers in most states. The littoral answer to your question is that the rules for passing apply to right or left-The passing vehicle is not allowed to exceed the speed limit even when passing, signals must be used, respect rights of way, etc.
Remember that in most cases passing on the right is more dangerous than the left. On the freeway most exit/entrance ramps are on the right, in town there are often more turn hazards in the right lane (which may be why folks stay in the left lane even when they shouldn't). It is not legal when going on the shoulder of the road.
We were driving through a canyon, spotted a man lying on the side of the road opposite, stopped and called out to him. He waved us off, so we left.
We saw a woman crying, screaming for help a few hundred yards down and asked her how we could help. She said she had to get out of the canyon.
We gave her a lift. We pulled onto the road, carefully, heading back the way she indicated, back the way we came.
When a car came speeding toward us from the rear, the young man in it decided that since a car was coming from the other direction, he'd take advantage of the shoulder to pass us, driving right into the sun.
The man on the side of the road didn't even have a chance to stand all the way up. The car plowed right into him ahead and to our right.
Worse, the man flew into the air and landed on top of our hood long enough to glimpse his mangled face, then slid under the front of our car and under.
The three of us were in shock and silent. We pulled over.
The young man in the speeding car did the same.
So did the other two cars that witnessed it.
The police came quick. They questioned everyone. I found out that I almost went to jail.
Oh, I had done nothing wrong, and the other witnesses, including the young man, made that clear, but our passenger was convinced for a bit that I was the one that had hit the man.
She was drunk, according to the officers. So was the man.
They were married. She watched her husband die right in front of her. The police officer patted my back and sent me home, saying not to worry, they have enough witnesses and that we should rest. We asked after the welfare of our passenger and they said they'd take care of her.
All for a little less time on the road, speeding on the right.
Changed our lives forever.
Changed that young man's life forever.
Changed that women's life forever.
Ended the man's life forever.

On a divided highway, passing on the right is illegal, although largely ignored in most places.
Other than that, such as in town, when there are two clearly marked lanes one may pass on the right.

It varies by state but generally there must be a legal lane and perhaps more then 2 lanes on the road

You're supposed to pass on the left but if they are in the far left lane and they don't get out of it, then you can pass on the right and you aren't going to get pulled over for it
