I am trying to work out what subrogation rights are, as my insurance company is using this against the person who hit my car, as they were not insured?

Off the top of my head, subrogation means that someone "stands in the shoes" of someone else. For instance, if your insurance company pays you on your claim, they are subrogated to your rights against the uninsured driver - they get your rights against that driver, and can sue in your place.

What this all means:
1. When the other person caused the accident, they owed you money to repair your vehicle.
2. Since your insurance company paid to have your vehicle fixed, the are able to subrogate the debt so the money is now due them.
3. If you had a deductible and they are able to collect the amount owed, you should receive your deductible back from the insurance company.
