Just wondering what happens then? Would the military have to disobey its commander and chief? Or the people would have to take over? Not saying that its going to happen, or needs to happen, just kind of wondering what would happen if the constitution is ultimately ignored.

Is there checks and balances now?

If there was would US citizens be in the distraught position they're in? Didn't the Pres just give himself unprecedented full control over emergency status? Just in time too since the 'gut' feeling in Wash seems to be we are headed that way.

Congress investigates the problems in the Executive branch, courts rule to reign in the Executive's overstepping of their powers, Congress moves to impeachment.

That's what was in the process with Nixon over Watergate.

then congress says fine guess what all of your programs you want, they shall get no funding. The president will veto this but I will assume he has pissed off every senator and member of the house so his veto will be overridden. Meanwhile the courts will be set up to reign in the madman in the whitehouse and congress will begin impeachment.

I'm sure some type of armed revolution would take place.

But being that we have so many checks and balances in place now, I really can't see this happening.

It can't. To try and do so would be acting contrary to the definitions laid down in the Constitution and possibly treasonous.
