The same way that Protestants broke away from the Catholic church but still called themselves Christians. In fact the same way the Mormon church itself was founded. And you're distorting Mormon history. The breakaway groups didn't come up with the idea of polygamy. This was a central tenet of the Mormon church for a long time, as I'm sure you're aware. When the church abandoned the practice for politial reasons, some true believers held to the old faith. Happens everytime a church changes it's policies.

First of all the name of the church is "The Church of Jesus Christ of Latter Day Saints," not "The Mormon Church." "Mormon" is a slang name attributed to it's members by their persecutors. It is the name of a great prophet and military leader who lived in the Americas around 400 AD and compiled the records of his people. Members of both the LDS church and the FLDS (Fundamentalist Church of Jesus Christ of Latter Day Saints) believe this book along with The Bible to be scripture. Since both churches claim to believe in The Book of Mormon their members are both commonly referred to as Mormons. This causes a lot of confusion and often leads people to label the LDS church with the same stigma as the FLDS church.
When the LDS profit declared that the practice of polygamy was no longer necessary and was to be done away with Many members were unwilling to accept that so they broke off and started their own religion. Originally polygamy was the only difference between the two religions, but today they are different in many ways.

As far as I know, there is no such thing as the Mormon church. It's a nickname for people and churches that use the Book of Mormon. If they continue to use it, then they can still be called mormons.
The leaders of the Church of Jesus Christ of Latter-day Saints, the largest "Mormon" sect, have even encouraged members to stop using the term "mormon" in that way.

They are referred to as fundamentalists. They left the church when polygamy was first banned by the church. They are the originals and the non polygamists are the the "new" members. The fundamentalists were given legal rights to the original Book of Mormon. The one commonly used now amongst the "new" church had to be altered to be legally used.

I wouldn't call your new church anything that has 'mormon' or any combinaton of 'latter day saint', as these names will be defended vigorously to your financial detriment by the church's army of stripling laywers. Sorta like "coke" was trademarked after coca cola got rich.
The church has already prosecuted a coffee shop owner that used the 'likeness of Moroni' on a tee-shirt. If they could sue you for saying 'jesus christ', they would.
Be careful when opposing the One True Church. They used to have Danites who would fix 'leaks', y'know what I mean?

If you don't like them, don't join them.

Polygamy is illegal, but the first ammendment states, among other things, freedom of religion. So people can preach whatever they want of whatever name they want, as long as they don't actually do it.
