The person is obviously doing it to avoid being on jury duty...honestly if I was the judge I would hold him in contempt of court

To all those folks who think that listening to an MP3 player during a trial is a good way to get off jury duty -- judges aren't dumb. In fact, as is clear from your answers, potential jurors are a lot dumber than judges. Sure, you'll get off jury duty -- but I hope you don't mind spending a night in jail, having your player confiscated, being slapped with a hefty fine, and spending the rest of your life with a contempt conviction tacked on to your record. So, please, go ahead and do it; then get back to Y!Answers and tell us how it went.

If there are alternate jurors listening to the case, the Judge will dismiss this juror. If there aren't any alternate jurors, the defense can file a Motion for a Mistrial.

First, give that player to the judge then make them pay a fine plus some community service. Then let the one on trial sue them for damages.
