You will need to be more specific. You husband buys property under a fake name. What line of business is he in? If your husband is a wealthy man or even just a shrewd business man then what he is doing may be perfectly normal. Business people have for years and will continue to buy other companies, property etc. under a D/B/A/ "doing business as" as my law firm has a different corporate name than my actual real name but it is also listed with the secretary of state, so anyone who reallly wanted to research any of my business dealings could easily find who the D/B/A is. My law firm for example bus propery, stock etc in the company name and I buy for my personal profile under my real name.

There are a multidude of reason why people buy property under an assumed or ficticious name. For example they do not want the competitors to know it is them bidding on said propert. A really good businness attorney can structure a corporation that leads back to your husband under sever different DBA"S for example co. abc d/b/a the fairfield grocery store d/b/a farmers seafood market, d/b/a south side shrimp/ dba Natalie's nutricious catering. and so on. It can be perfectly legal and good business practice and a good legal tax shelter.

However if your husband is just buying property under a fake name that is completely untracebale to him, not registrede etc, it could be illegal.

For divorce purposes it is extremely difficult to trace dummy corporations without an expert and investigator in the area. You probably would not get far on your own. If your hubbie owns alot of property and you are considering divorce it is impoprtant that you get the best family law attorny available and fast. Beat him to the punch, if you retain the best then he wikl be prohibited from retaing the same because of a conflict of interest. even if the divorce is a way off, retain the best attorney now so that when then time comes he is your attorney and ready and willing to go to work for you. if you try to do this when some mediocre attorney to cut cost you WILL PAY IN THE END BY NOT GETTING WHAT IS RIGHTFULLY OWED TO YOU. DO NOT CUT CORNERS WHEN IT COMES TO HIRING AN ATTORNEY JUST AS YOU WOULD NOT GO FOR THE CHEAPEST BRAIN SURGEON IF YOU HAD BRAIN CANCER. YOU GET WHAT YOU PAY FOR

I'll just add that if this fake company is legit and Incorporated, then all those assets are neither owned by you or your husband. An Incorporated Company is a separate legal entity.

Sounds a little fishy without details, but you got excellent advice above.

It can do you both harm, remember what is purchased in a marriage is the responsibility of both. You say fake co name, are you both paying the taxes on this property, why would you both have a fake name. Talk to your lawyer on this one.

Depending on the state...probably yes.

If he is caught, you may also get in some legal trouble--because they can say you knew what was going on and didn't do anything about it. They can charge you for accessory to a crime, and worse, conspiracy to commit a crime or defraud someone.

So you should keep careful records and seek some legal experts opinion. Keep yourself covered--legally!

Any real property or goods acquired during your marriage is yours as well as his. If the business was formed after your marriage that is yours as well.

Yes make sure you can prove it and that you know what he has bought. you will still get a protion if not half of what he owns it is the law.
