My mom has been receiving child support ever since I was five years old and has always kept the whole check. Now I am 19 years old I will turn 20 in October and I wanted to know , can I now obtain the right to have my child support check since I am over 18? I'm considering moving out of my mom's house because me and her husband has a terrible relationship and I wanted to know if I can get it now to pay my rent when I move out . Is it possible? what if she doesn't want to give it to me???

well i would assume that if your mother was still supporting you while you are in school (whether or not she pays for your school) especially if you still reside under her roof, she is due the money. most states say that it continues until 21 if in college unless emancipated. and at any time you are over the age of 18, and you move out, you become legally emancipated. so if you move out, you both will probably lose the funds. however, if you stay at your moms, she is feeding you and paying for your electricity so you have light to study, she deserves the money.

If you are still living with your mother,then she is still supporting you and is entitled to the child support. If and when you decide to move out,then I suppose you could petition the court to have the checks given to you,but not until then. Now that you are an adult,are you paying your share of the rent,utilities,food,buying your own clothing and paying for ALL of your expenses? If not,then that is what the child support check your mother receives is going for.

Child support is for the support of the child. In the legal sense, it is awarded to your mother for the Subject of the order (you).

Since you are the subject of the order and not a principle, you are not entitled to the support unless your mother wants to give it to you.

FOR THOSE OF YOU QUESTIONING SUPPORT PAST 18:

Some states require support until 21 such as New York.

ok.... Now, I"m speaking from a perspective from the state I'm in. Once you turn 18, the parent no longer has to pay for you. Kinda like "dropping off the roll books". Honestly, I doubt you are going to be able to do a single thing. Child support is paid to "take care of the child".

I'm goin to answer your last question? Why doesn't she give it to you. Its pretty simple. She's using it as income to support herself, not necessarily you. Just think it you took that money from her. I GUARANTEE she will try and make you feel like you are abandoning her and, here's the kicker, you only want the money for yourself.

Bottom line, you need to talk to an attorney or go on line and find the DFS in your state and get an answer. They can AT LEAST lead you. I don't envy you. You are definitely in a rock in a hard place.

Why is she still getting support checks anyway? If your are 19 going on 20? Are you a full time student?

Anyway, your answer is no.

The child support money your mother got is hers not yours. She raised you and paid for what you needed growing up. How she did it doesnt make what she has saved up yours. You have no right to that money. You are now an adult and she is not getting money in support for you.

Unless you go to college, child support ends at 18. You mother was supposed to use the money to raise you. But you could contact a lawyer to see what your rights may be.

If you are 19, unless their was some stipulation in the divorce decree, you are considered an adult and no longer entitled to support.

The money is supposed to be for you not your mother. So either you will get the check or it will be terminated.
